I have an idea of a product that I have not seen anywhere on the market I have created the product and people love it How do I stop giving it away for free and start selling it? It's an unusual product.

Before talking to anyone about it get a signed NDA (except that is for Chartered Patent Attorneys...you are covered by their charter)

Firstly, make sure it is NEW (do product and patent searches)...Then make sure it WORKS (build one and test it if you haven't already). Lastly protect it:- make sure its YOURS... apply for a patent.

Thats the easy bit tho' ...The hard part is turning a promising idea into a product.

  • Go to the UK patent office and European patent office and make an application for a patent. Otherwise when you start selling it you will be out of business within months.

    Then approach companies who sell similar products and make a deal to manufacture and market it. Don't give up even if the companies are difficult to convince.

i'm 13 but in december i will be 14. i am really mature and careful and even though you don't know me even so. i have looked after my brother, and helped out with babysitting before, a few times with my friends. what do you think?

I think so, yeah. I babysit. Mostly family, but I babysat the same 2 boys for 2 and a half years, a 5 and a 7 year old. Its fun, but it can be really difficult. For instance, I babysat a 14 month old, its REALLY hard, I would start with some family or some family friends, that way, if you make a mistake, they are more likely to be understanding. It can be hard at times, but dont be afraid to call the parents if you need help or advise. A tip: If the kids arnt listening, threatening to tell they're mother/father does help sometimes, :P But you dont actually have to. Also, if you are doing it with friends, make sure you still remember to do your job.. sometimes you can get into hanging out with your friends, and not pay so much attention to the kids :P If you choose to babysit, remember the most important thing is to stay safe, and have fun.

When do I need ro register my small business?

I am just starting to sell items on eBay. I'm mainly getting clothing etc from my friends and family - I'm not paying for any goods, just selling them for my own profit.

I recently bought a wholesale lot of clothes from another vintage seller, I'm now worried that this is leaning more towards becoming a small business venture and I'm not set up for it.

I'm still working full-time so this would be additional income.

Any advice would be much appreciated.

What a lot of silly advice.
Once you start to receive income from selling items which are not yours, then you need to register with HMRC as self employed. You can do this online at www.hmrc.gov.uk. As you already have another job, all your profits will be liable to tax, so you need to keep really accurate records.

Ok, i work in an office on a 40 hour a week contract. I got told yesterday the business is not going well at the moment and they are going to cut everyones hours to 34 or make someone redundant. They are talking to everyone individually and will then make a decision and want to enforce it by 1st October. Can they do it that quick? We are not in a union. Thanks

Yes they can. Check your contract though as it may state they have to give you a weeks warning about reduced hours. A hint to you though is to make yourself invaluable to them. Show how the company benefits from having you on the team. We employe 10 staff and have faced similar situations, and worked hard not to make anyone redundant. What stood out to us though were those who made an effort to understand, those who asked questions, those who came into the office when they were unsure or needed to ask more. Those who came in, on the weekend when we really needed to help (of course they were paid for it). It is a difficult time for business owners, often they don't know how to talk to staff and hence all of a sudden staff find out there is redundancy talks. Be proactive in your work position.

  • At least they have had the respect to tell you what is going on. There are some who go in to work to be told there is no job anymore as the firm has gone bust. You are fortunate to be cut down by just 6 hours, so you won't be losing a great deal.

    As there are hundreds of people chasing one job nowadays, you are in a more enviable position than you realise. Show your support, you need to keep your job!

I'm a seller on eBay and I feel sick to death of there shi+.. They charge you to list an item. They charge you a percentage if it sells. Then PayPal take a percentage. Then if you're paid in a different currency they charge you to change to dollars. And to top it off they give you a terrible exchange rate. If there is ever a problem it is almost impossible to get to talk to someone on the phone and if you email them it takes 4 to 5 days for them to answer. And usually they just tell you that you emailed the wrong department.
So here's my question: Is there any alternative to these cowboys?

Every auction/ classified site that is serious about making money, has to charge for you to use what they've created. However eBay has raised their fees too much and to suit them; they make loads of money. Therefore sellers have to put their prices up to make a living and this si not set to change for the better. If you want better use sites like Etsy(handmade sellers) eBid, Amazon, Craigslist, Shopit, Kijiji, CQout to sell on.

Comcerning eBid.net it is the most popular eBay alternative, with currently over 2.4 millions auctions, very low fees, friendly co-sellers, responsive administration, ease of listing. They accept paypal pppay and google checkout - good variety.

  • I'm sick of email too! I sold a DAB radio, the buyer claimed it was damaged although it was almost brand new (only ever tried). After a month of disputes through paypal, they decided (some how) they buyer should return it to be and I would have to refund him.

    I get the radio back and guess what... no damage. I'm left with with bad feedback and have wasted time and money. Its a joke! Complained to ebay and paypal and they just say there is nothing they can do........
  • I suppose you are paying to advertise your stock on their website so it's fair for them to charge listing fees and a percentage of the sale price.

    eBid UK is an alternative, they don't have listing fees and don't take a final percentage. They were voted best eBay Alternative in 2008.

Sounds very like an IR35 type case. HMRC might well still see you as an employee, it all depends on just what contracts your Ltd Co have, and whether these are all with your current employer - in which case you would typically be an employee, not a contractor.

With the product liability laws, being "strict liability doctrine" one needs to be careful to use hairdressing exactly as it says on the topic container.

The hairdressing product makers escape liability for the most part, by putting warnings on their products. If someone like a hairdresser makes a mistake, and they did not heed the warning labels, they may become liable...there may be no defense to a legal claim based upon negligence, because in "strict liability doctrine" there burden of profe is on the defendant..this notion is a switch for strait neglience-where the burden of proof is on the plaintiff.

Queen, for us to be of help where your basket company is located will be of great help. Especially if it is out of the U S. What is the spoken language of the customers that will want your baskets? (what demographic are you trying to attract?) What kind of gift baskets are they? Corporate baskets placed in hotels for visiting corp execs? or baskets filled with different kinds of foods, fruits, candies, media or toys? For the entire John Q Public? I know that individuals can make a SAR request under the Data Protection Act (in the UK), but is it possible for a business to do the same?

eg To make a request for copies of all correspondence that company A holds on the business, which will also include a letter sent to company A from company B who were working on my businesses behalf?

This is just an example, not the actual scenario i am looking for but i hope you understand what i mean. And if the SAR is just for individuals, is there something similar that a business may be able to use?

The Data Protection Act only applies to individuals' data, and as far as I am aware there is no equivalent for businesses.

In your example, company A could easily argue that to release the documentation would compromise their commercial confidentiality, as it could reveal the nature of any special deals between A and B.

You should have a look at freelance sites such as getafreelancer. With your skills you should have no problems getting orders. also internet marketing forums - you can post a thread with your services there and people can contact you there as well.

I have sold an designer bag which I bought on eBay myself and buyer states that this is fake. Before listing my item i took this bag to store for confirmation that this is authentic, but buyer says same thing that he/she took this bag to check and was told its fake!!! So I have a case open against me on eBay and I am confused what should I do, how can I proof this bag is real? And could I get a trouble if it will be escalated to Pay pal claim?

I would just offer the buyer a refund and then you can take the bag to another store to check its authenticity. This is better than having a case against you on ebay. Hope this helped :D

  • You can't prove it's real unless you got something in writing from the store you took it to. Why not offer a refund in exchange for the return of the bag and start again? If they don't want to return it, then it's likely they're trying to scam you. In this case, ask them to provide written proof, on the stores letterhead, that it's a fake. Once you get that, you should call the person whose name is on the letter and check it's authentic. If it turns out that it is a fake, re-negotiate the cost with the buyer.

  • If they paid by PP they will need to supply written evidence that the bag is not authentic, if they do this they will be told to return and assuming it is the same bag you sent you will be required to refund.
    As for the advice to empty your PP account, that is going to open up a world of pain as PP will pay the money and come after you for it via debt collectors.
    I would simply ask for it to be returned if is authentic as you claim then you have lost nothing!

    best thing to do is have them send it back and refund the price paid (but NOT the postage), on the basis of no bad feedback either way.

    Don't send money until you confirm that it is indeed the same bag you sent that has come back and you aren't the victim of a switch.

    Your only alternative is to offer some cash (£10?) back and see what they say. If only a shop can tell, they don't really have a problem, especially at the price they paid you. tell them.

  • If you have documentation from the store stating the back was authentic, then forward that information to back up your case. If you do not have any such proof, then you really have nothing. One way to tell if it was fake when you bought it: Authentic bag - $250; fake bag - $29.

    Many of these things are cheap Chinese counterfeits. I would not buy anything like this on eBay. There are too many crooks and cheats out there.

  • You have received both good and bad advice here.

    Your problem is not uncommon. Esp with designer items. Yes, there are buyers who specialize in ripping off diesigner label sellers, especially if they are relatively new to selling.

    Conversely, there are also a lot of sellers who will try to get away with selling counterfeit labels.

    My advice to you is to get caring, professional advice. You can do that, gratis, from a large pool of ebay sellers who have knowledge of this problem, and some who have been in the same boat you are in.

    They will tell you EXACTLY what PayPal policies are, and wht are YOUR best options at this moment.

  • go back to the store and ask if they remember, could you have some kind of confirmation ...

    also contact ebay yourself, tell them what the buyer is saying and tell them where u went for the clarification that the bag was genuine and who you spoke to, give the store address and as much contact details as possible. ( give this to ebay not the buyer )

    tell the buyer you have contacted ebay yourself and you do not believe them, as for the details of where they took the bag and who they spoke to, and ring them yourself, or tell her u rang and they had no recollection of it.

    sounds like this person is trying to keep the bag and get a refund, a common ebay trick

If you have had its authenticity checked out and its definetley real, they maybe trying to scam you here!! How much was the bag? is it worth the hassel for them to do this??   • I'm going to suggest that you not do what I'm hearing.

    Business Plans, while having a great deal in common with each other from one to the next, don't copy in quite that way.

    If you want to go more generic and build your plan from a general manufacturing and distribution plan, altering the necessary bits to account for what's special about fish processing . . . well, that will be fine. But if you find what you've asked for and just fill in the blanks you will have created a plan that won't be of very much use to you; a smart potential investor will see right through it, and if you want the plan as a guide for yourself you'll have created something that . . . isn't.

  • Official gear is generally marketed by individual clubs. So, you could try contacting them direct. You do not see West Ham official kit in sports shops, at least in the London area, because they sell through their own outlets. Cannot say what other clubs' arrangements are. Most official gear is made in China, but so are the fakes!

Iv been sent a postal order by someone who i sold something to, but they've put the wrong surname on the postal order and its crossed, so i can only cash it at the bank. but because the name on it isnt the same as the name my bank acount is in i cant cash it. is there anything i can do to get my money?

you need to send it back to buyer uncrossed ones can be cashed in post office if they still have recipet they can exchange it

Hi!
Firstly, at the end of your first year and every subsequent full year of having a Limited Company, you will need to do a return to Companies House, so, for example, if you started trading on 24.07.09 you would need to do an annual return from this date to 23.07.10. You should employ an accountant to do these for you, the cost is around £300-£400 for their services depending on how small your business is and also depending on how 'in order' your accounts and receipts are, so it is advisable to log every detail of your income and expenditure and keep your receipts in order. Your accountant will tell you whether you have made enough profit to pay Corporation Tax and you will be sent a reminder to pay any outstanding amounts. You are usually given around six months to pay these amounts.
You also need to file a return to say that you are still trading, again to Companies House, which costs around £15 - they will send you a reminder to do this.
You will also be required to complete a Self-Certification Tax form which is sent out to you in about August each year and should be returned to the Inland Revenue sometime in September (it will give you the date on the form). Again, your accountant can help you with this form - it requires details of your shareholding in the company which sounds more complicated than it is!
Lastly, depending on how you pay your wages, if your tax and national insurance are deducted 'at source' you will be required to forward these amounts to the Inland Revenue on a quarterly basis and complete an end-of-year return at the beginning of April each year. Contact the Inland Revenue for assistance on how to do this. When my hubby set up his own business, muggins here got the books to do and I asked the Inland Revenue to come out and explain how to do his wages and returns. They are extremely helpful and offered various courses which I could attend to help iron out any problems.
I know this all sounds very complicated but if you keep your accounts in order, you should be just fine!

I take bsic items of clothing, like hats and sweaters, paint them up and sell them on ebay. I've done it as a hobby but orders started to increase gradually. I often lean the brand name on the items, like nike or adidas.
At what point do i need to declare my income? And can i get into trouble for altering branded goods?

eBay plus paypal charges are so high you would not want to pay any extra, You can go around laws by creating second account. with another ebay acount you can still use same paypal account.

Your best bet is to look at the site below and contact your local college.

It could cost as much as £1200, depending on the course you do and where you do it. If you are claiming job seekers allowance, you might be able to get them to pay for it if they think you will get a job after doing the course.

(Incidentally it's not called CORGI anymore, it's now known as the "Gas Safe Register")

Just looking for a bit of advice. My friend is planning to set up a portacabin business but he is looking for some advice on who his target market would be. For the portacabin side of things i have advised building contractors but he mainly wants to know who typically buys large modular buildings and temp to perm portable offices. Try gaming companies, if you put gaming chairs in them & computers ETC then they will either buy/rent them of you fior quite a bit of money, its mainly down to taking there games around the country so thats why they would be interested.

  • I don't know about large modular buildings since people are working from home or laptop, PDA, from home or anywhere. BUT what about small buildings? Like hunter cabins? I know that it is different, but maybe hunters would pay for him to build something on their property. Not like a house, but something they could use on weekends. When you said portacabin, I though cabin. anyhow good luck. Tell him not to limit himself.

Postage question advice required please, Read Below?

A couple of weeks ago I sold a camera Lens on ebay for £100 in the listing I put 2nd class standard postage at a cost of £7.00

To protect myself I actually sent in first class signed for delivery at a cost of £9.00 I have the receipt of postage.

The buyer has since provisionally filed a dispute with Paypal saying Item not recieved!!.

I checked the Post office tracking site and it says item still at the post office I sent it from.

Paypal have put a temporary hold on my funds for this transaction

Were do I stand in this as im worried that the Post office may have lost it, is the buyer Liable to take the financial loss as they agreed to sencond class standard without requesting any insurance

When infact I actually sent it first class signed for.

I am glad you sent it signed for, as at least it proves you are not a liar!

However, in this case, the buyer is not a liar either (in Paypal disputes, everybody always thinks the other is lying for some reason...). In this case you are both honest!

Sending it signed might have saved you here, since Paypal may well take the £100 back from your account, as the recipient has not received the goods they have paid for when all is said and done.

If the item gets "lost" in the post, you will be entitled to about £20, the maximum they will pay for uninsured items. However, since it was sent signed for, they take a little extra care with them, so the chance of getting your lens back is much greater than it would have been thankfully!

Now hopefully if you are still on good terms with the buyer, you can tell them to phone 0845 611 2382 and get the package redelivered to them on a convenient day, or they can phone their local sorting office and get it redelivered that way.

Now hopefully this will cure it, especially if you tell Paypal they could easily get it redelivered. What MIGHT have happened (I do not know this actually did happen of course, it is only a possibility...), but they might have had buyer's remorse at that price and simply refused to sign for it, or ignored the card the delivery person is SUPPOSED to leave behind, saying they tried to deliver a package that needed a signature, but could not get an answer, so the package will be held at the local sorting office before being returned to sender.

My Posties are very good and always leave cards, but I have heard other parts of the country are not always as good, so this is only a possibility of what might have happened, a card might not have been left, or the card was "stolen" or "misplaced", especially if it was sent to flats. It might even have blown away.

There is one final thing to consider - There are Postal strikes going on at the moment, could the package simply be sitting at there local sorting office, because there was no-one to deliver it and it is now part of the "backlog"? Hopefully Paypal will take this possibility into consideration as well!

You are a trainee manager and you have just been moved to a new store and have been asked to do the annual perfomance appraisals with your new colleagues. You have reviewed one particular colleague's previous appraisal and is is very positive. However in the first week you have been there, they have been late and not dealth with customers correctly. This is the first time you have done the teams appraisals.
Question (1): What is the best course of action to take first?
Question (2): What is the worst course of action to take first?
Options are:
a) ask another department manager to help you with the appraisal.
b) carry out the appraisal and tell the candidate, they need to stop being late and deal with customers better.
c) carry out the appraisal; address the lateness and bad customer service another time; just try to build a relationship.
d) re-arrange meeting for a few weeks time, to allow you to get to know the colleague and observe them further.

Well if I had the time I would put off the appraisals for say a month so that the staff get used to my methods, then lead by example (be first in, treat the customers well). You now have something that the other staff can judge you by and see what they need to do to meet your standards.

Then you will be in a position to offer constructive criticism of any employees performance if they aren't up to scratch as they will know what you expect from them.

  • B) Sort of.. Carry out the appraisal and discuss with them the reasons for the lateness and inappropriateness with the customer. Performance issues need to be dealt with as soon as possible. Details are fresh in peoples minds, and it is not fair to criticise someone for being late weeks ago.

    Agree a plan of action with them for future conduct to avoid a reoccurrence, and a timescale of when they will next be reviewed in relation to it. Stick to your guns without being dictatorial, or you will lose control of them.
  • I would do option b that is your best choice. The behavior needs to be corrected. If you wait then the employee will continue to do it and it could encourage others and decrease moral. Also it isn't fair to displine people for something that happened weeks ago. Details will still be on the mind so you can work with this person to correct the problem. You might also want another manager to help you just because you don't really know the candidate.
